2.5 Excavation and earthworks

Subclass 2.5

Except for work included in subclasses 2.2 and 2.4 of Schedule II, this subclass authorizes construction work involving the digging, moving, compacting, leveling of earth or granular materials, including work relating to small structures and similar or related construction work.

Additional explanations

This subclass is fully included in subclass 2.6.

This subclass includes in particular construction work relating to:

  • the construction of streets, roads or paths in earth and granular materials, including ditches;
  • the leveling and scraping of streets, roads or paths made of dirt and granular materials;
  • culverts intended to ensure the free passage of water under an entrance connecting the building to the road (calvette);
  • the installation of dry stone drains or agricultural drains;
  • the installation of prefabricated concrete stairs and porches;
  • gabions and riprap;
  • the excavation of trenches for “trench deposits” (burial of household refuse);
  • the excavation of the trench, the installation and connection of the general water connection and the sewer connection to the main municipal pipes as well as the backfilling of the trench;
  • the assembly and anchoring of playpen games and furniture in a public park (11.2);
  • the rental of equipment or machinery with an operator when the lessor is responsible for the execution and quality of the construction work;
  • small works of art;
  • surfaces of outdoor sports fields made of grass or clay.

NB: Despite the wording above, the private roads (streets, roads or paths) are not subject since they are not civil engineering works.

No license is required for the work:

  • excavation for the sole purpose of decontaminating the soil (to be verified with the Ministry of Sustainable Development, Environment and Parks);
  • assembly and assembly of playpen games having a free-standing base;
  • cleaning ditches;
  • landscaping around a building, that is to say:
    • earthworks (modification of the terrain profile),
    • retaining walls made of wood, stones or prefabricated blocks,
    • planting flowers, trees and shrubs,
    • sowing and laying of sod in rolls (peat),
    • swimming pools, basins, statues, fountains or water gardens which are not civil engineering works,
    • fences, when they are not specifically required by the purpose of the building or civil engineering work,
    • the irrigation of lawns, plants, shrubs (except when this work is part of a civil engineering work);
  • concerning steps made of concrete blocks and pavers resting on gravel and serving as access to a building without being attached to it and completing the landscaping;
  • emptying septic tanks, sumps, grease traps, oil interceptors, etc.
