You are renovating a building into a single-family home in which you and your family will live.<\/p>\n
You wish to carry out some renovations in certain rooms in order to be able to rent them.<\/p>\n
So, what jobs can you do yourself and what is the procedure for renovating the rooms for rent?<\/p>\n
<\/p>\n
The R\u00e9gie du b\u00e2timent particularly applies the Building Act ( RLRQ., C. B-1.1<\/a> ) and its regulations, including the Regulation respecting the professional qualification of contractors and owner-builders ( RLRQ., C. B-1.1 r.9<\/a> ) relating to contractor licenses.<\/p>\n <\/p>\n Subject to a few exemptions, a license is required for the contractor or owner-builder who performs\u00a0 or have construction work carried out, carried out on the site itself and on the job, in particular a building.<\/p>\n You can refer to articles 2, 41, 46 and 48 of the Building Act<\/a> (RLRQ., C. B-1.1) following\u00a0 :<\/p>\n Chapter\u00a0 B-1.1<\/p>\n BUILDING ACT<\/strong><\/p>\n CHAPTER\u00a0 I<\/strong><\/p>\n APPLICATION AND INTERPRETATION<\/p>\n SECTION\u00a0 I<\/strong><\/p>\n APPLICATION<\/p>\n 1 \u00b0\u00a0\u00a0to a building used or intended to be used to house or receive people, animals or things, including the materials, installations and equipment of this building;<\/p>\n 2 \u00b0\u00a0\u00a0equipment intended for public use;<\/p>\n 3 \u00b0\u00a0\u00a0the following installations not attached to a building:<\/p>\n 3.1 \u00b0\u00a0\u00a0a petroleum equipment installation;<\/p>\n 4 \u00b0\u00a0\u00a0in the vicinity of these buildings, equipment and installations;<\/p>\n 5 \u00b0\u00a0\u00a0to any other civil engineering work, but only for the purposes of applying Chapters IV and V.<\/p>\n 1985, c. 34, a. 2;\u00a0 1991, c. 74, a. 2;\u00a0 2005, c. 10, a. 25.<\/p>\n <\/p>\n SECTION\u00a0 I<\/strong><\/p>\n APPLICATION AND INTERPRETATION<\/p>\n 1985, c. 34, a. 41;\u00a0 1998, c. 46, s. 14;\u00a0 2005, c. 10, a. 43.<\/p>\n <\/p>\n SECTION\u00a0 II<\/strong><\/p>\n LICENSES<\/p>\n No contractor may use, for the execution of construction work, the services of another contractor who does not hold a license for this purpose.<\/p>\n 1985, c. 34, a. 46;\u00a0 1991, c. 74, a. 27;\u00a0 1997, c. 43, a. 875;\u00a0 1998, c. 46, s. 15.<\/p>\n 1985, c. 34, a. 48;\u00a0 1997, c. 43, a. 875.<\/p>\n <\/p>\n <\/div><\/div>\n Here are some exemptions in reference to the situation\u00a0 described in this article and for which the\u00a0 owner-builder is not required to have a license.<\/p>\n 1)\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0When the owner is\u00a0 a physical person\u00a0 and that the work is aimed at a “single-family house” (eg isolated, semi-detached or in a row) or a “structure\u00a0 \u00bb(Eg garage)\u00a0 intended for his personal use or that of his family. (Building Law, Article 49 paragraph 2)<\/p>\n If you are renovating your building into a single-family home and want to rent rooms there, you cannot take advantage of this exemption because with the rental of rooms, your residence is no longer only intended for your personal use and that of your family.<\/p>\n Your building qualifies more as a ”\u00a0 bedroom house\u00a0 “.<\/p>\n Rooming house\u00a0\u00a0\u00a0 not.\u00a0 f.<\/strong><\/p>\n The English layer\u00a0 rooming house\u00a0 is acceptable because it is legitimized in French in Quebec and is integrated into the French language system; the complementarity relation introduced by the preposition\u00a0 of\u00a0 is used to determine what the house contains, as in\u00a0 apartment building, for example. Furthermore, this syntactic construction is similar to that of\u00a0 guest house, common especially in France. There are no other terms in French to speak of this North American reality.<\/p>\n Source\u00a0 : Office qu\u00e9b\u00e9cois de la langue fran\u00e7aise, 2017<\/p>\n Despite this, a natural person cannot carry out construction work relating to an installation intended to use gas, an installation of petroleum equipment or an electrical installation if he does not hold a license.\u00a0 appropriate.<\/div><\/div>\n 1 \u00b0\u00a0\u00a0for those who have construction work carried out by a licensed contractor, whose main activity is the organization or coordination of construction work whose execution is entrusted to others;<\/p>\n 2 \u00b0\u00a0\u00a0for the natural person who carries out or has carried out construction work on a single-family house or a work intended for his personal use or that of his family.<\/p>\n However, a natural person may not carry out construction work at an installation intended to use gas or an installation of petroleum equipment or at an electrical installation if he is not a contractor.<\/p>\n 1985, c. 34, a. 49;\u00a0 1991, c. 74, a. 28;\u00a0 2005, c. 10, a. 44.<\/div><\/div>\n <\/p>\n 2)\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0The owner-builder is a natural or legal person, and has\u00a0 all\u00a0 construction work for the same project by\u00a0 a\u00a0 only contractor holding an appropriate general contractor’s license.<\/p>\n (Building Law, Article 49 paragraph 1)<\/p>\n <\/p>\n 3)\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0The work in question is authorized by license subcategories of\u00a0 annex III\u00a0 only (eg paint, gypsum, etc.). This work may be carried out, in whole or in part, by the owner-builder with the help of his employees or by contractors holding an appropriate license, regardless of the estimated amount of the work.<\/p>\n Chapter\u00a0 B-1.1, r. 9<\/p>\n Regulation respecting the professional qualification of contractors and owner-builders<\/strong><\/p>\n Building Act<\/strong><\/p>\n (Chapter B-1.1, s. 185).<\/p>\n CHAPTER\u00a0 II<\/strong><\/p>\n LICENSES<\/p>\n SECTION\u00a0 I<\/strong><\/p>\n CATEGORIES OF LICENSES<\/p>\n The license subcategories of the specialized owner-builder category are those provided for in Schedule II, by replacing the words \u201cspecialized contractor\u201d and \u201ccontractor\u201d by the words \u201cspecialized owner-builder\u201d and \u201cowner-builder\u201d, respectively. Wherever they are and with the necessary modifications.<\/p>\n D. 314-2008, a. 10.<\/div><\/div>\n You can consult appendix III of the regulation and the list of sub-categories of the RBQ to find out what work you can do yourself with your employees.\u00a0 :<\/p>\n 4)\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0The owner has all the work carried out\u00a0 Annex II\u00a0 through\u00a0 just one\u00a0 general contractor or by\u00a0 just one\u00a0 contractor holding a specialized contractor’s license including all the license sub-categories required for this work, regardless of the estimated amount of the work. The contract may also include work from Annex III. The owner-builder may, for the same project, carry out himself with the help of his employees or entrust contractors with appropriate licenses,\u00a0 of the work of Annex III. The owner-builder must therefore hold an appropriate license if he awards more than one contract (more than one contractor) for Annex II work.<\/p>\n <\/p>\n Chapter\u00a0 B-1.1<\/p>\n BUILDING ACT<\/strong><\/p>\n CHAPTER\u00a0 I<\/strong><\/p>\n APPLICATION AND INTERPRETATION<\/p>\n SECTION\u00a0 I<\/strong><\/p>\n APPLICATION<\/p>\n In the pursuit of these objects, this law sees in particular the professional qualification of contractors and owner-builders.<\/p>\n 1985, c. 34, a. 1;\u00a0 1991, c. 74, a. 1;\u00a0 2005, c. 10, a. 24.\u00a0<\/div><\/div>\n Remember that all the work referred to in Annex II must be entrusted to ONE SINGLE contractor.<\/p>\n <\/p>\n 5)\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0He holds a contractor’s license with the subcategory (s) relevant to the work he wishes to perform on his property (s).<\/p>\n A contractor does not need to hold an owner-builder’s license when the work that he performs or has performed on his own account corresponds to the subcategories of his construction contractor’s license.<\/p>\n Note that the work must be performed on the property of the contractor (company). This exemption does not apply to the manager (s) of the company who wish to carry out construction work on their personal property.<\/p>\n <\/p>\n Chapter\u00a0 B-1.1<\/p>\n BUILDING ACT<\/strong><\/p>\n CHAPTER\u00a0 I<\/strong><\/p>\n APPLICATION AND INTERPRETATION<\/p>\n SECTION\u00a0 I<\/strong><\/p>\n APPLICATION<\/p>\n 2 \u00b0\u00a0\u00a0ensure the safety of the public who access a building or equipment intended for public use or who uses an installation not attached to a building or a petroleum equipment installation.<\/p>\n 1985, c. 34, a. 1;\u00a0 1991, c. 74, a. 1;\u00a0 2005, c. 10, a. 24.<\/div><\/div>\n Note that for each of these cases and except exemptions provided by regulation, all contractors working for the owner-builder must have an appropriate license (or with the required subcategories) for their part of the work.<\/p>\n A general contractor in small buildings (1.2) can take out a contract for an industrial building classified F2 of not more than three floors and a building area of not more than 600 m2 (including the extension if necessary).<\/p>\n You can consult authorized works<\/a> for each of the sub-categories on the RBQ website.<\/p>\n <\/p>\n The competence of the workforce (worker competency card) is governed by the Act respecting labor relations, vocational training and workforce management in the construction industry (RLRQ., C. R-20<\/a> ) and the Regulation respecting the vocational training of manpower in the construction industry.
